The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 6, 2010, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2010021929, in Book No. 868, at Page 765 and modified in Document No. 2016004853 MOD, in Book No. 965, at Page 734 and modified in Document No. 202100001615 MOD, in Book No. 1042, at Page 97, Melanie A Adkins did convey unto Richard A. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 - Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:

The following described tract or parcel of real estate situate in the City of Oak Hill, Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to wit:
LOT NO. 101 of the Oak Hill Truck Farms, situate near the City of Oak Hill, Pleateau District, Fayette County, West Virginia, as shown more fully on a map or plat or record in the Office of the County Clerk of the Fayette County Commission in Map Book 4, at page 192, said lot fronting 100 feet on Valley Street (formerly erroneously referred to as 200 feet on Valley Street) and extending back adjacent to Lot 100, 121.3 feet, and being 100.15 feet on the back and extending back with Lot 102, 126.8 feet.
And being the same property acquired by Melanie A. Adkins by deed dated December 6, 2010, from, Mary J. Blankenship, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 141 Valley Street, Oak Hill, WV 25901.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.

Petition to Update the MRBC Rates

REVISED NOTICE OF FILING AND HEARING

NOTICE is hereby given that Appalachian Power Company and Wheeling Power Company (the Companies), public utilities, have, on March 15, 2024, filed with the Public Service Commission of West Virginia a Petition to update the Modified Rate Base Cost (MRBC) surcharge revenues. The Public Service Commission's June 30, 2021 Order in Case No. 20-1012-E-P required the Companies to file an annual MRBC update in March of 2022, 2023, and 2024. If approved, the increased rates will apply to electric service to approximately 460,774 customers in the counties of Boone, Brooke, Cabell, Clay, Fayette, Greenbrier, Jackson, Kanawha, Lincoln, Logan, Marshall, Mason, McDowell, Mercer, Mingo, Monroe, Nicholas, Ohio, Putnam, Raleigh, Roane, Summers, Wayne, Wetzel, and Wyoming.

The Companies propose to recover total incremental revenue requirements for certain rate base increases added between October 1, 2022 and September 30, 2023. The proposed increased rates and charges will produce approximately $32.2 million annually in additional revenue, an increase of 1.82% over revenue at current rate and usage levels. The average monthly bill for the various classes of customers will be changed as follows:

The increases requested vary by customer class and customer usage level. Individual customers may receive an increase that is greater or less than average. Furthermore, the requested rates are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this Petition. Any increase in rates will not become effective until authorized and approved by the Public Service Commission. The Public Service Commission has scheduled an evidentiary hearing on Monday, August 20, 2024, immediately following the close of the hearing in Case No. 24-0332-E-P in the Howard M. Cunningham Hearing Room, Public Service Commission Building, 201 Brooks Street, Charleston, West Virginia.

Anyone desiring to intervene should file a written petition to intervene by May 31, 2024. Failure to intervene timely can affect your right to participate in the proceeding. Requests to intervene must comply with the Commission's rules on intervention. All protests or requests to intervene should briefly state the reason for the protest or intervention.
