The following described tract or parcel of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in the City of Mount Hope, Fayette County, West Virginia, and being more particularly bounded and described as follows, to wit: Beginning at three white oaks on a bench at the point of a ridge corner of McKell on the Evans tract; thence N 42 1/2 E 80 feet to a stake; thence N 33 1/3 W 400 feet to a stake; thence SE feet to a stake in the old line between McKell and this lot; thence with this old line S 33 1/3 E 420 feet to the point of beginning. Map 12 Parcel 50.
Being the same property conveyed
by fee simple deed from Donald L Grunenberg, , and William R Grunenberg, , to Debra Lynn Brellahan, dated 02/02/2004 recorded on 02/08/2004 in Book 601, Page 374 in Fayette County Records, State of of WV.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 906 Highway 21, Mt Hope, WV 25880.

The referenced real estate will be conveyed of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.

Annual Pipeline Replacement and Expansion Program and Application to Implement Modification to Existing PREP Gathering Program

NOTICE OF FILING AND HEARING

On May 31, 2024, Hope Gas, Inc. (Hope) filed its Annual Pipeline Replacement and Expansion Program (PREP) Filing with revised PREP Rates, pursuant to W. Va. Code sect. 24-2-1k, which authorizes the Public Service Commission of West Virginia (Commission) to approve cost recovery of projects to replace, upgrade, and expand natural gas utility infrastructure that are deemed to be just and reasonable and in the public interest.

Additionally, pursuant to Commission Order in Case No. 23-0317-G-PC, Hope shall assess and collect a surcharge rate increment (Legacy Surcharge) on each customer that becomes a customer of Hope through Hope's acquisition of additional gas utilities (or their assets) and merged into Hope on and after January 1, 2023. The Legacy Surcharge shall be a rate equal to Hope's PREP rate for the customer's appropriate class.

In its base case PREP Filing, Hope projects PREP capital investment for calendar year 2025 of $65.5 million as part of its General Program (core distribution system) and Gathering Program (gathering facilities) under multi-year plans. The PREP Filing also contains a true-up for actual versus projected 2023 calendar year PREP capital investment activity for both the General Program and the Gathering Program. The PREP covers several categories of plant asset replacements and improvements, including mains, service lines, regulator stations and other plant equipment. These plant investments are proposed to be made in Hope service territories throughout the State. These projects are identified in the PREP Filing, which is on file and available for public inspection at the Commission's offices at 201 Brooks Street, Charleston, West Virginia.

In this annual PREP filing, Hope is also reconciling actual costs under Southern Public Service Company's (Southern) Infrastructure Replacement and Expansion Program as directed by the Commission in a prior order approving Hope's acquisition and merger of Southern into Hope.

Hope proposes to recover costs associated with these investments through an increment within the fixed or volumetric, base rate component of its rates depending on the applicable rate schedule under which service is rendered, to be effective on November 1, 2024. Hope projects that if the program and rate increments are approved as requested, the average monthly bill for the various classes of customers will be changed on November 1, 2024, as follows.









The increases shown are based on averages of all customers in the indicated classes. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges are only a proposal and are subject to change (increase or decrease) by the Commission in its review of this filing. Any increase in rates and charges will not become effective until authorized and approved by the Commission.

The Commission adopted the following procedural schedule:


If the Commission receives no opposition to the PREP Filing within one week of the hearing date, the hearing may be waived, and the Commission may issue a final Order within 150 days of the filing date.

Anyone desiring to intervene should file a written petition to intervene within twenty (20) days following the date of this publication unless otherwise modified by Commission Order.
