The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 4, 2021, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 1049, at Page 89, Jamie Ann Kelley did convey unto Paul O. Clay, Jr., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on
September 24, 2025, at 1:00 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:
BEING the surface of that certain parcel of land located in the City of Oak Hill District of Fayette County, West Virginia, being Lot No. Twelve (12), Section Three (3), COLLINWOOD ACRES, as shown more fully on a map entitled "Collinwood Acres, Section 3, Oak Hill, Plateau District, Fayette County, West Virginia", Scale 1 inch = 50 feet, dated April 1972, made by Bennett-Naeve & Thomas Engineering Company, Oak Hill, West Virginia, which map is of record in the Office of the Clek of the County Commission of Fayette County, West Virginia, in Map Book 17, at Page 95.
And being the same property conveyed unto the party of the first part herein by deed of Jennifer Hope, (fka Jennifer Hall) dated the 4th day of June, 2021, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument.
This instrument is made subject to all lawful restriction, reservations, covenants and conditions, made and contained in prior deed in the chain of title to the above described real estate.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 307 Collinwood Drive, Oak Hill, WV 25901.
AND BEING the same real estate which was conveyed to Jamie Ann Kelley, by Deed dated June 4, 2021, from Jennifer Hope, fka Jennifer Hall, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 813, at Page 53.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale
