The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated September 30, 2021, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 1055, at Page 104, Thomas Jeremy Warford did convey unto Paul O. Clay Jr., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on
May 21, 2026, at 2:00 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:
The following described tract or parcel of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situated in Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:
BEGINNING at a pin on Noble Street, corner to Noble and Boles; thence S 53-34' 103.74 feet to a pin; thence S 31-08' E 79.98 feet to a pin; thence N 64 41' E 104 feet to a pin on noble Street; thence N 31-15' W 100 feet along Noble Street to the Point and place of Beginning, and containing 0.21 acres.
And being the same property conveyed unto the party of the first part herein by deed of James R. McMillion, dated the 27th day of September, 2021, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument.
This instrument is made subject to all lawful restrictions, reservations, covenants and condition, made and contained in prior deeds in the chain of title to the above described real estate.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 105 Noble Street, Oak HIll, WV 25901.
AND BEING the same real estate which was conveyed to Thomas Jeremy Warford, by Deed dated August 27, 2021, from James R. McMillion, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 818 at Page 257.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
