at the Mitchell Power Plant

NOTICE OF FILING

On February 18, 2026, Appalachian Power Company and Wheeling Power Company (jointly, the Companies) filed a verified Application for Certificate of Public Convenience and Necessity to Construct a Mechanical Draft Cooling Tower at the Mitchell Power Plant pursuant to W. Va. Code Â§ 24-2-11. In order to address the structural needs of the Unit 2 Cooling Tower at the Mitchell Power Plant located near Moundsville, West Virginia, and to ensure the continued operation of that plant for the benefit of their customers, the Companies intend to construct a new mechanical draft cooling tower, replacing the existing Unit 2 Cooling Tower, and then partially demolish the existing Unit 2 Cooling Tower. The need for the proposed construction project, and a more detailed description of the project, are set forth in the Companies' Application and the witness testimony provided therewith.

The West Virginia jurisdictional share of the cost of the proposed construction project is currently estimated at approximately $95.5 million and is proposed to be recovered through the Companies' Construction Surcharge. If the project is approved as proposed, it would result in an annual increase in revenue of $15,029,710 (a 0.76% increase), and the impact on an average monthly bill by customer category will be as follows:

The increases shown are based on averages of all customers in the indicated class. Each class may receive an increase or decrease greater or less than stated here. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. Any increase in rates and charges will not become effective until authorized and approved by the Commission. If a hearing is scheduled, notice will be given of the time and place of the hearing.

Anyone desiring to protest or intervene should file a written protest or notice of intervention within thirty days of the date of this Notice, unless otherwise modified by Commission order. Failure to timely protest or intervene can affect your rights to protest any rate increases or to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission's rule on intervention set forth in the Commission's Rules of Practice and Procedure. TOWN OF ANSTED SEWER RATE ORDINANCE

A public hearing will be held on June 4, 2026 at 6:30 p.m., prevailing time, on the following ordinance. Any person interested may appear before the Town Council of the Town of Ansted (the "Town") at the Town Hall, 20165 Midland Trail, Ansted, West Virginia, and present any comment or protest thereto. Following which hearing Town Council shall take such action as it shall deem proper. The proposed ordinance is below and may be inspected by the public at the Office of the Town Recorder, Town of Ansted, 20165 Midland Trail, Ansted, West Virginia during regular office hours:

SCHEDULE I
(Effective 45 Days After Enactment)

APPLICABILITY
Applicable in entire territory served.

AVAILABILITY OF SERVICE
Available for general domestic, commercial and industrial sanitary sewer service.

RATES
Flat rate per 1,000 gallons used per month $24.12 per 1,000 gallons

MINIMUM CHARGE
No bill will be rendered for less than $48.24 per month, which is equivalent of 2,000 gallons per month at a rate of $24.12 per 1,000 gallons.

UNMETERED RATE
The unmetered monthly bill shall be $96.48 per month (based on 4,000 gallons).

CONNECTION CHARGE
The connection charge for each new tap to the system shall be $300.00 or the actual costs as solely determined by the Town.

DISCONNECT FOR NON-PAYMENT
If any bill is not paid within 20 days after the bill due date, water service to the customer will be discontinued and will not be restored until all past due bills have been paid in full, together with all penalty charges, the disconnection charge, and the reconnection charge, subject to the applicable rules of the Public Service Commission of West Virginia.

DISCONNECT/RECONNECT/ADMINISTRATIVE FEES
Whenever water service has been disconnected for nonpayment of sewer bills in conjunction with a water service termination agreement with West Virginia American Water, a disconnection fee of $20.00 shall be charged; or in the event the delinquent sewer bill is collected by the water company, an administrative fee of $20.00 shall be charged.

Whenever water service has been disconnected for nonpayment of sewer bills in conjunction with a water service termination agreement with West Virginia American Water, a reconnection fee of $20.00 shall be charged; or in the event the delinquent sewer bill is collected by the water company, an administrative fee of $20.00 shall be charged.

DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full when due, ten percent (10%) will be added to the net current amount unpaid. This payment is not interest and is to be collected only once for each bill where it is appropriate.

SECURITY DEPOSIT
A security deposit will be required for all new accounts opened within the territory served. The deposit shall not be more than fifty dollars ($50) or two-twelfths (2/12) of the average annual usage of the applicant's specific customer class, whichever is greater.

RETURNED CHECK CHARGE
A service charge equal to the actual bank fee assessed by the banking institution to the sewer utility up to a maximum of $25.00 (per WV Code 61-3-39e) will be imposed upon any customer whose check for payment of charges is returned by the banking institution due to insufficient funds.

MUNICIPAL EXCISE TAX SURCHARGE
The municipality listed below, having imposed a public utility tax computed on the basis of two percent (2%) of revenues from the sewer service sales by the sewer utility within the corporate limits of such municipalities. shall be billed as a "surcharge" to customers receiving service within said corporate limits.

The sewer utility is required to collect the utility tax pursuant to West Virginia Code 8-13-5a.

Customers receiving sewer service within the corporate limits of the specified municipality shall pay a surcharge on the following surcharge rates.

STORM SEWER DRAIN AND BROKEN OR DAMAGED SERVICE
CONNECTION
No person shall connect or permit to be connected a storm sewer or storm drain to a sanitary sewer, or otherwise allow or permit water to enter a sanitary sewer, or continue to have a storm or storm drain connected to a sanitary sewer, or continue to allow or permit storm water to enter a sanitary sewer.

The provision of this section shall also apply outside the municipality where sanitary sewers are connected to the sanitary sewer system of the Town of Ansted.

Whenever the Town of Ansted has discovered that a customer's broken or damaged service connection, roof drain, downspout, storm sewer or other similar or like facilities conducting surface water have been connected to the Town of Ansted sanitary sewer system, and such customer has failed to take appropriate action, within thirty (30) days of receipt of a demand by the Town of Ansted Sewer Department in accordance with the Rules and Regulations of the Public Service Commission of West Virginia to eliminate such connection or defect, a surcharge will be imposed upon the customer calculated on the basis of the following formula:

S = A x R x .0006233 x C

S - The surcharge in dollars.

A - The area under roof and/or the area of any other water collection surface connected to the sanitary system, in square feet.

R - The measured monthly rainfall

.0006233 - A conversion factor to change inches of rain x square feet of a surface to thousands of gallons
of water.

C - The Town of Ansted Sewer department approved rate per thousand gallons of sewage treated.

The Town of Ansted shall not impose the surcharge unless and until the customer has been notified by certified mail, return receipt requested, or by hand delivery, that it has been established by smoke testing, dye testing, or on-site inspection that rain or other surface water is being introduced into the sanitary sewer system at the customer's location, and that the customer has not acted within thirty (30) days from the receipt of such notice to divert the water from the sanitary sewer.

Said surcharge shall be calculated and imposed for each month that said condition continues to exist. Failure to pay the surcharge and/or correct the situation shall give rise to possible termination of water service in accordance with the Rules and Regulations of the Public Service Commission of West Virginia.

The above rates and charges shall be applicable for any owner or occupant of each and every lot or parcel of land or building within or without the corporate limits of the Town of Ansted and having any connection to the sanitary sewer system of the Town of Ansted.

The Smithers Volunteer Fire Department, Inc. was organized as a nonprofit corporation under section 501Ã‚Â©(3) of the internal Revenue Code. Effective December 3, 2025, the department was officially decertified by the West Virgina Stare Fire Marshal's Office and is no longer authorized to operate as a fire department within the state of West Virginia.

Due to this decertification, the organization has ceased operations and is proceeding with a dissolution in accordance with West Virgina state law and federal regulations governing nonprofit entities.

As part of this process, all remaining assets, after satisfaction of any outstanding debts and obligations, shall be distributed exclusively to public safety, or governmental purposes/entities consistent with the requirements of a 501Ã‚Â©(3), or to a governmental agency.

Under the proposal, the licensee would: (1) replace the Unit 1 and Unit 2 turbines and generators, (2) construct a new switchyard near the existing powerhouse, (3) upgrade one of the existing primary transmission lines and abandon the other in place, (4) construct a new access road near the existing powerhouse, (5) install a new prefabricated metal building near the existing powerhouse and substation, (6) upgrade ancillary equipment. The replacement of Units 1 and 2 would increase the project's authorized installed capacity from 102 megawatts (MW) to 108.5 MW and increase the maximum hydraulic capacity from 10,160 cubic feet per second (cfs) to 10,380 cfs. During powerhouse outages associated with the licensee's proposal, all flows would be spilled into the bypassed reach and the licensee's ability to provide recreational flow releases would be dependent on project inflows. The licensee would continue to operate the project in run-of-river mode during and following construction. Following construction, the licensee would increase the minimum flows in the bypassed reach and increase the number of recreational flow releases while shortening the duration of each recreational flow release.

Upon the effective date of this Ordinance, the corporate limits of the Town of Gauley Bridge shall be altered to include the annexed territory, and the official boundary maps of the Town shall be amended accordingly.

SECTION 3. Municipal Services.

Municipal services shall be extended to the annexed territory in accordance with the service plan adopted by the Town Council and consistent with West Virginia Code Â§ 8-6- 5.

SECTION 4. Zoning and Ordinances.

Upon the effective date of annexation, the annexed territory shall be subject to all ordinances, regulations, and municipal authority of the Town of Gauley Bridge, including but not limited to planning, zoning, taxation, and code enforcement provisions.

SECTION 5. Filing and Recording.

The Mayor and Recorder are authorized and directed to:
1.Certify a copy of this Ordinance;
2.File the same with the County Commission of Fayette County, West Virginia;
3.Cause a certified copy to be recorded in the Office of the Clerk of the County Commission of Fayette
County; and
4.Take all other actions required by West Virginia Code Â§ 8-6-5 to effectuate this annexation.

SECTION 6. Effective Date.

This Ordinance shall become effective upon adoption and completion of all statutory requirements under West Virginia Code Â§ 8-6-5.
