NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 2, 2005, executed by Borrower, James Shuff, to Richard A. Pill or David D. Pill, either of whom may act, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 746, at Page 361. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1137 Rogers Street, Oak Hill, WV 25901. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 23, 2022, of record in the Clerk's Office in Book 1072, Page 166. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

The following described real property, to-wit: LOTS 5, 6, & 7, located and lying in the Tuggle Truck Farms Addition to Oak Hill, in Fayette County, West Virginia, and being more particularly described and bounded as follows, to-wit: Being LOT Numbers, 5, 6 and 7 in Section 2 of the "Tuggle Truck Farms Addition to Oak Hill, West Virginia in Fayetteville District, Fayette County, West Virginia. Said Lots are shown on a map entitled "Tuggle Truck Farms Addition to Oak Hill, West Virginia, October 29, 1937, J. E. Larew, C.E. Beckley, West Virginia, and which said maps are of Record in the Fayette County Court Clerk's Office, West Virginia. This conveyance is made subject to all covenants, conditions, restrictions and easements apparent or of record. This deed is made and accented subject to all mineral reservations, mining rights, reservations and exceptions contained in all former deeds conveying the property herby conveyed. Being a part of the same property conveyed by William H. Lowery and Ave F. Lowery, husband and wife, and James W. Lowery and Tonna Lowery, husband and wife, Margaret Sue Lowery Bailey and Roland Bailey, husband and wife, to Charles F. Austin and Donna S. Austin, husband and wife, by deed dated the 2nd day of February, 2004, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book No. 601 at Page No. 382. SUBJECT PROPERTY INCLUDES MANUFACTURED HOME SERIAL #, MODEL# 4764P, MANUFACTURED 2006, WITH SERIAL NUMBERS VAFL519A/B61866-1N13, WHICH IS AFFIXED AND ATTACHED TO THE LAND AND IS PART OF THE REAL PROPERTY. Being the same property conveyed to James Shuff by the Deed dated July 5, 2005 and recorded in Deed Book 614 at Page 39 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.

Notice is hereby given that Appalachian Power Company and Wheeling Power Company (the Companies), public utilities, have, on April 30, 2024, filed with the Public Service Commission of West Virginia a Petition to update their Vegetation Management Program (VMP) rates as required by previous Commission Orders. If approved, the increased rates will apply to electric service to approximately 462,328 customers in the counties of Boone, Brooke, Cabell, Clay, Fayette, Greenbrier, Jackson, Kanawha, Lincoln, Logan, Marshall, Mason, McDowell, Mercer, Mingo, Monroe, Nicholas, Ohio, Putnam, Raleigh, Roane, Summers, Wayne, Wetzel, and Wyoming.

The Companies propose to increase VMP rates by approximately $1.2 million, an increase of 0.07% annually, effective for a period of two years. If approved, the average monthly bill for the various classes of customers will be changed as follows:


1 Excludes Special Contract customers who are billed standard tariff rates.

The increases shown are based on 1,000 Kwh monthly usage for residential customers and the monthly average usage of all customers in the other classes. Individual customers may receive an increase that is greater or less than average. Furthermore, the requested rates are only a proposal and are subject to change.

If the rate including the fixed monthly charge plus a kWh rate is approved, the residential monthly bill at various usage levels would be changed as follows:


The Public Service Commission will conduct a public comment hearing in this matter on September 30, 2024, beginning at 5:00 p.m. The public comment hearing will be held virtually, allowing for interested persons to make a comment telephonically, through the Microsoft Teams application from the internet, or in-person at the Commission headquarters. Interested persons intending to make a virtual public comment should register with the Commission by 4:00 p.m. on Thursday, September 26, 2024. Registration may be made by any of the following methods:

(1) Through the Microsoft Teams meeting link located on the Commission's website, http://www.psc.state.wv.us under the "PSC Hot Topics" section located at the top of the homepage;
(2) By calling 304-340-0836 (Karen Hall) or 304-340-0820 (Andrew Gallagher); or
(3) By emailing khall@psc.state.wv.us or agallagher@psc.state.wv.us.

The link for the Microsoft Teams meeting will also be in a future press release from the Commission. Interested persons wishing to comment in-person at the public comment hearing should attend and sign up to speak at 5:00 p.m. at the Public Service Commission, Howard M.
