Notice is hereby given that REPUBLIC ENERGY, LLC P. O. BOX 69, 622 PACKS BRANCH ROAD, PAX, WV 25904 has submitted an application for the reissuance of Article 11/WVNPDES Permit No. WV1022121to the Department of Environmental Protection, 1159 Nick Rahall Greenway, Fayetteville, WV 25840 in order to operate, maintain, and monitor the MT5-B Surface Mine (S301006) and associated haulroads and access roads in the Little Eagle, Eagle, Eagle "A", Powellton, Lower Campbells Creek, No. 2 Gas, Peerless, Alma, Lower Cedar Grove, Chilton, and all splits seam/mineral bed. The operation will discharge treated and stormwater into Willis Branch, unnamed tributaries of Willis Branch, Maynor Branch of Dixons Branch, unnamed tributaries of Right Fork and Right Fork of Dixons Branch, all of Paint Creek of Kanawha River; Lick Run of Clear Fork of Coal River of Upper Kanawha River and is located 2.3 (miles), southwest of Pax, in Plateau, Town, and Clear Fork Districts of Fayette and Raleigh Counties, Longitude 81° 17' 40" and Latitude 37° 53' 24 " (Coordinates from USGS Topographic Map).

The Department of Environmental Protection is seeking information on private surface water intakes for human consumption located in the above listed receiving streams and located down stream of this operation. Please provide your name, phone number, mailing address, the name of the stream being with the intake, and the physical location of the intake. This information needs to be submitted to the address above.
An anti-degradation review has been conducted. Tier 1 protection is afforded because effluent limitations ensure compliance with water quality criteria for all designated uses. Where applicable, a full Tier 2 anti-degradation review has been conducted.

Comments on the Article 11 WV/NPDES application or requests for a public hearing regarding the Article 11/NPDES application shall be in writing and if a public hearing is requested shall state the nature of the issues proposed to be raised in the hearing. Such written comments or requests should be sent to the Department of Environmental Protection (DEP) at the address above, and must also reference the Article 11/NPDES permit number shown above. Comments received by May 4, 2026, or thirty (30) days from date of publication, will be considered. A copy of the Article 11/WVNPDES application, draft permit, rational page, and fact sheet (if required) will be available for inspection and obtaining copies during normal business hours at the DEP Regional Office located at the address above.

On July 31, 2025, Mountaineer Gas Company (Mountaineer) filed its annual Application for approval of an Infrastructure Replacement and Expansion Program for 2026 (2026 IREP) with revised IREP rates for 2026, pursuant to W.Va. Code § 24-2-1k, which authorizes the Public Service Commission of West Virginia to approve cost recovery of projects to replace, upgrade and expand natural gas utility infrastructure that are deemed to be just and reasonable and in the public interest.

In its Application, Mountaineer forecasts capital investment for calendar year 2026 of $77,000,000 as part of its multi-year plan. The 2026 IREP covers several categories of plant asset replacements and improvements, including mains, service lines, measurement and regulator stations, and house regulators. These plant investments are proposed to be made in Mountaineer service territories throughout the State. These investments are identified in the Application, which is on file and available for public inspection at the Commission's offices at 201 Brooks Street, Charleston, West Virginia and which may be viewed on the Commission's website, www.psc.state.wv.us.

Mountaineer proposes to increase IREP revenues by approximately $5,239,000 for IREP investments made from 2023 to 2026 through an increased IREP rate component to be effective on January 1, 2026, within the fixed or volumetric base rate component of its rates, depending on the applicable rate schedule under which service is rendered. Mountaineer projects that if the program and IREP rate increase are approved as requested, the average monthly bill for its various classes of customers will be changed on January 1, 2026 as shown below:

The Commission set a procedural schedule, including a hearing date on the Application that will begin at 9:30 a.m. on November 14, 2025, in the Howard M. Cunningham Hearing Room at the Commission's offices at 201 Brooks Street, Charleston, West Virginia. If no opposition to the Application is received by the Commission within one week of the hearing date, the hearing may be waived, and the Commission may issue a final order within 150 days of the Application filing date.

Anyone desiring to intervene should file a written petition to intervene within 10 days following the date of this publication unless otherwise modified by Commission order.
