The Work will be substantially completed within 60 calendar days after the date when the Contract Times commence to run and completed and ready for final payment within 90 days after the date when the Contract Times commence to run. Liquidated damages shall be $500.00 per day.

Envelope No. 2 labeled "Bid Proposal" shall also be placed inside of Envelope #1.

Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR - 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 "Bid Proposal", will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 "Bid Proposal" will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.

A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to the City of Smithers in an amount equal to five percent (5%) of the base bid.

Contractors are required to provide the Drug Free Workplace Certification in accordance with WV Code 21-1D-5.

Notice of Federal Wage Requirements - Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.

All Bidders are required to have a West Virginia Contractor's License per Section §30-42-12 of the West Virginia Code.

Suspension and Debarment - Recipient shall not entertain the use of businesses that are listed on the "System for Award Management" (SAM) at www.Sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

Bidders are advised that the Contract awarded under this Advertisement for Bids is to be funded (entirely/or in part) by a grant from the United States Department of Housing and Urban Development (HUD). Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract.

This Community Development Block Grant project is to be financed in part by a grant from the U.S. Department of Housing and Urban Development (HUD) and the West Virginia Department of Economic Development/West Virginia Community Advancement Division and shall be referred to as Project #T30-11723 - Gateway Center Roof Replacement.

Bidders on this Work will be required to comply with the President's Executive Order No. 11246 and "HUD Section 109", which prohibits discrimination in employment regarding race, creed, color, sex, or national origin.

The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.

The parties to this Contract agree to comply with HUD's regulations in 24 CRF part 135, which implement Section 3. Bidder's attention is directed to the Section 3 "Clause" set forth in the Contract Documents.

The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135.

Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts.

Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprise participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.

Any Contractor submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed.

Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.

Roberts did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerks Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Plateau District n/k/a Pax District, Fayette County, West Virginia, and more particularly described as follows:

The following described lot or parcel of surface land, together with the improvements thereon, appurtenances thereunto belonging, and rights incidental thereto, situate in the Town of Pax, Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:

Lot No. 8 as shown on a map entitled Map of Property for A.W. Pettry, Showing Subdivision in Pax, West Virginia, which said map is of record in the Fayette County Commission Clerks office in Map Book No. 17 at page 73; reference to which map is hereby made for a more full and complete description of said Lot No. 8.

And being the same property conveyed to Hubert D. Roberts and Shirley A. Roberts, his wife, by Hubert D. Roberts, et ux, by their Deed dated May 25, 2005, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 613, at Page 208.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 128 Brookside Lane, Pax, WV 25904.

AND BEING the same real estate which was conveyed to Shirley A. Roberts, by Deed dated June 8, 1981, from A.W. Pettry and Frances A. Pettry, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 400, at Page 138.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale
