COAL TRANSPORTATION RULE WAIVER REQUEST
On August 15, 2025, Coal-Mac Met LLC petitioned the Public Service Commission of West Virginia for a temporary waiver of Rule 4.7.B of the Coal Transportation Rules, which became effective July 7, 2004.
Rule 4.7.B requires: In order to constitute accurate reporting under the statute and these rules concerning shipments of coal upon a coal resource transportation road, shippers and receivers must meet the following requirements: Receiver. A receiver shall determine and report the gross vehicle weight of such coal shipment with scales certified by the Division of Labor.
The certified truck scales at the Deep Water facility have become inoperable due to a mechanical failure, therefore, the site is currently unable to capture those certified gross vehicle weights as required by 4.7.B. Coal-Mac Met is requesting temporary relief of Rule 4.7.B to receive coal at their Deep Water facility without a certified truck scale in operation while the truck scales are repaired or replaced for a period of 90 days.

Your documents should also be forwarded to Coal-Mac Met LLC, 1245 22 Mine Road, Holden, WV 25625. So that your documents can be properly filed, note that it is for Coal-Mac Met LLC's application to waive Rule 4.7.B filed on or about August 15, 2025.
