NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, a certain Deed of Trust dated March 9, 2010, was executed by Janet Leaetta Honey to Richard A. Pill, Esquire, Trustee, securing Wells Fargo Bank, N.A., in the amount of $274,000.00, of record in the Clerk's Office in Book 855, at Page 633. This Deed of Trust was assigned by Wells Fargo Bank, N.A. to Nationstar Mortgage, LLC D/B/A Champion Mortgage Company by Assignment dated August 4, 2017, of record in the Clerk's Office in Book 638, at Page 860. Further assigned by Nationstar Mortgage, LLC D/B/A Champion Mortgage Company to the Secretary of Housing and Urban Development by Assignment dated April 12, 2021, of record in the Clerk's Office in Book 668, at Page 301; and
WHEREAS, a certain Second Deed of Trust dated March 9, 2010, was executed by Janet Leaetta Honey to Richard A. Pill, Esquire, Trustee, securing securing the Secretary of Housing and Urban Development in the amount of $96,000.00, of record in the Clerk's Office in Book 580, at Page 938; and
WHEREAS, a default has been made in the covenants and conditions of the above Deeds of Trust in the payment due on May 28, 2025, was not made and remains wholly unpaid as of the date of this notice, and no payment has been made sufficient to restore the loan to currency; and
WHEREAS, the entire amount delinquent as of July 22, 2025 is $273,732.91; and;
WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Deeds of Trust to be immediate due and payable; and
NOW THEREFOR, pursuant to powers vested in it by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. 3751 et seq, by 24 CFR part 27, subpart B and by the Secretary's designation of Bailey & Slotnick as Foreclosure Commissioner by FORECLOSURE COMMISSIONER DESIGNATION dated November 7, 2017, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 10, at Page 295, notice is hereby given that the borrower has defaulted under the Deeds of Trust and the Foreclosure Commissioner will sell the following property described to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on:

All those certain lots or parcels of real estate together with singular the improvements thereon and the appurtenances thereunto belonging, situate in Fayetteville District, Fayette County, West Virginia, and more particularly described as follows:

Situated in the State of West Virginia, County of Fayette and in the Township of Fayetteville.

Lot Nos. 30 and 31 as shown on a map entitled "Revised Laurel Terrace Subdivision, Fayetteville, New Haven District, Fayette County, West Virginia, Scale 1" = 50', March, 1974, Pentree, lnc.", which map is of record in the Fayette County Commission Clerk's Office in Map Book 18, at page 21, together with the rights incidental thereto and the appurtenances thereunto belonging, and the right to use in common with the other owners of lots in said subdivision the streets, alleys and way therein.

Commonly known as: 161 S. Lee Addition, Fayetteville, WV 25840.

Being the same property conveyed unto Janet Leaetta Honey from Keith Ray Honey by deed dated September 29, 1998, of record in the Clerk's Office in Deed Book 553 at Page 704. Janet Leaetta Honey died intestate on March 30, 2022, and pursuant to the administration of the estate her interest in and to the subject property descended to Brian Honey, Shawn Honey and Jennifer Smith.

TERMS OF SALE:

1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2) There will be no proration of taxes, rents or other incomes or liabilities, except that the Purchaser will pay, at or before closing, his prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.
3) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code sect. 11-22-2.
4) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
5) The Foreclosure Commissioner reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Foreclosure Commissioner.
6) The Foreclosure Commissioner shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
7) The total purchase price is payable to the Foreclosure Commissioner by cashier's check, cash or money order within thirty (30) days of the date of sale with a minimum deposit of $27,000.00 payable to the Foreclosure Commissioner by cashier's check, cash or money order at the time and place of the sale. There will be no refund granted of any amount if the third-party purchaser elects not to purchase the property for any reason.
8) The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a cashier's check or money order made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.
9) If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the deposit or, at the election of the foreclosure commissioner and after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.
10) There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the borrower to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the Deeds of Trust are tendered to the Foreclosure Commissioner, in the form of a certified or cashier's check payable to the Secretary of HUD, before public auction of the property is completed.
The amount that must be paid if the Deeds of Trust are to be reinstated prior to the scheduled sale is $273,732.91 as of July 22, 2025, plus all other amounts that would be due under the Deeds of Trust if payments under the Deeds of Trust had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner's attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.
Tender of payment by certified or cashier's check or application for cancellation of the foreclosure sale shall be submitted to the address of the Foreclosure Commissioner provided below.

2025 Distribution System Improvement Charge.

NOTICE OF FILING & HEARING

On June 28, 2024, West Virginia-American Water Company (WVAWC) filed an application for approval of a Distribution System Improvement Plan and Charge (Application) pursuant to the direction of the Public Service Commission of West Virginia (Commission) in its February 24, 2016 order that resolved WVAWC's 2015 rate application, Case Nos. 15-0675-S-42T and 15-0676-W-42T.

WVAWC proposes to invest approximately $40.6 million in water and $3.2 million in wastewater infrastructure replacement and system upgrades in 2025. The investment will include the replacement of transmission and distribution mains, hydrants, water service lines, meters, wastewater collection mains, manholes, wastewater service lines, pumping equipment, treatment and disposal equipment, and investment in troubled systems. To recover the costs related to the investment WVAWC is requesting an increase to its Distribution System Improvement Charge (DSIC). The projects proposed for 2025 are identified in the Application, which is on file and available for public inspection at the Commission's offices at 201 Brooks Street, Charleston, West Virginia, and may be viewed on the Commission's website, www.psc.state.wv.us.

As with the DSIC currently in place, WVAWC proposes to recover costs associated with these investments through a separate rate component on customer bills, calculated as a percentage of the total monthly bill for service (comprised of both the minimum meter charge and the volumetric rate component). WVAWC proposes to include a wastewater system improvement charge as a component of the DSIC rate component to recover proposed qualified investment in wastewater utility plant as authorized by the Commission in its March 1, 2024 order in Case No. 23-0558-WS-DSIC. The proposed DSIC rate combines the Company's DSIC qualified wastewater revenue requirement with its water revenue requirement to calculate a single DSIC rate that is the same percentage adder for both water and wastewater customers.

WVAWC projects that if rate increments are approved as requested, the current 4.23% DSIC/WSIC adder will be increased to 7.01%, representing an increase of approximately 2.78% for average monthly usage bills. The average monthly bill for its various classes of water and sewer customers will change as follows:

The increases shown above are based on averages of all customers in the indicated class. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average. The requested rates and charges are only a proposal and are subject to changes (increases or decreases) by the Public Service Commission in its review of the filing. The new DSIC rate increment will become effective as ordered by the Commission.

The Commission set a hearing date on the Application which will begin at 9:30 a.m. on November 6, 2024, in the Howard M. Cunningham Hearing Room at the Commission's offices at 201 Brooks Street, Charleston, West Virginia. The Commission may cancel the hearing for good cause shown. Interested persons intending to attend the hearing should monitor the web docket.

The increases shown above are based on averages of all customers in the indicated class. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average. The requested rates and charges are only a proposal and are subject to changes (increases or decreases) by the Public Service Commission in its review of the filing. The new DSIC rate increment will become effective as ordered by the Commission.

The Commission set a hearing date on the Application which will begin at 9:30 a.m. on November 6, 2024, in the Howard M. Cunningham Hearing Room at the Commission's offices at 201 Brooks Street, Charleston, West Virginia. The Commission may cancel the hearing for good cause shown. Interested persons intending to attend the hearing should monitor the web docket.

Anyone desiring to protest or intervene should file a written protest or request to intervene that briefly states the reason for the protest or request to intervene. Requests to intervene must comply with the rules on intervention set forth in the Commission's Rules of Practice and Procedure and must be filed within twenty (20) days following the date of this publication unless otherwise modified by Commission order. The Commission will receive public comments throughout the entirety of the proceeding. All written comments and requests to intervene should state the case name and number and be addressed to Karen Buckley, Executive Secretary, P.O. Box 812, Charleston, West Virginia 25323.
