TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated March 30, 2001, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 614, at Page 86, Donald L. Epperly and Maxima L. Epperly did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on Monday, August 28, 2017, at 3:00 p.m. The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the New Haven District, Fayette County, West Virginia, and more particularly described as follows: TRACT ONE: BEING the surface of LOTS NO. TWELVE (12) and THIRTEEN (13) of the PRITT SUBDIVISION, New Haven (formerly Nuttall) District, Fayette County, West Virginia, as shown by a map thereof recorded in the Fayette County Court Clerk's Office with a deed from Katharine Huffman Pritt and Bert R. Pritt, her husband, to M.G. Stone, dated June 14, 1948 and recorded in Deed Book 134 at page 428, said map being recorded in Map Book 8 at page 100, to which deed and map reference is here made AND FURTHER BEING the surface of a PARCEL OF LAND which lies between said Lot No. 13 and the L.C. Murphy, of which this is a part, N. 25 53' 00" W., a distance of 143.08 feet to a point, corner to Nora Small's 1.5 acre tract and the tract herein described; thence leaving said Route 60/50 and with Small, N. 79 08' 31" E. passing a point on the east right of way line of said turnpike at a distance of 15.53 feet, for a total distance of 118.33 feet to a rebar set on the west right of way line of U.S. Route 60, corner to the tract herein described; thence with the west right of way line of said Route 60 the following four calls, S. 16 12' 00" E. passing a point, corner to aforementioned Lot 13 of said subdivision, at a distance of 0.89 feet, for a total distance of 44.59 feet; thence S. 77 19' 00" W., a distance of 5.00 feet; thence S. 19 04' 00" E. a distance of 20.00 feet to a point, corner to Lots 12 & 13 of said subdivision; thence S. 17 05' 00" E., a distance of 60.00 feet to a rebar set at the corner of Lots 11 & 12 of said subdivision and the tract herein described; thence leaving said U.S. Route 60 and with the line between said Lots 11 & 12, S. 70 09'28" W., a distance of 90.87 feet to the BEGINNING, and containing 0.314 acre, more or less, as surveyed by Hesco Land Surveying in February, 2001 and as shown on a map attached hereto and made part of this description. All bearings being taken from the subdivision meridian. TRACT TWO: BEING the surface of a strip of land containing 0.039 ACRE, located in New Haven (formerly Nutall) District, Fayette County, West Virginia, more particularly described as follows: BEGINNING at a point on the east side of West Virginia Secondary Route 60/50, corner to Nora Small's 1.5 acre tract and James J. & Margaret S. Murphy and the tract herein described; thence leaving Murphy and along the east side of said Route 60/50, N 25 53' 00" W., a distance of 15.07 feet to a point, corner to the tract herein described; thence leaving Route 50/60 and through Nora Small's 1.5 acre tract, of which this is a part, N. 79 22' 51" E., passing a rebar set as a reference on the east right of way line of the old James River & Kanawha Turnpike at a distance of 15.55 feet, for a total distance of 120.93 feet to a rebar set on the west right of way line of U.S. Route 60, corner to the tract herein described; thence with Route 60, S. 16 12' 00" E., a distance of 14.11 feet to a point, corner to the tract herein described; thence leaving Route 60 and with Nora Small's 1.5 acre tract, S. 79 08' 31" W., passing a point on the east right of way line of the aforementioned turnpike at a distance of 102.80 feet, for a total distance of 118.33 feet to the BEGINNING and containing 0.039 of an acre, more or less, as surveyed by Hesco Land Surveying in February, 2001 and as shown on a map attached hereto and made a part of this description. All bearings taken from the Pritt Subdivision Meridian. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Rt 60 Lots 12 & 13, Pritt S/D, Lookout, WV 25868. AND BEING the same real estate which was conveyed to Donald L. Epperly and Maxima L. Epperly by deed dated March 30, 2001, from Susan Sevcik as attorney-in-fact for Margaret S. Murphy, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 576, at Page 532. The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in "AS IS" condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
