NOTICE OF TRUSTEE'S SALE PUBLIC AUCTION In execution of a certain Deed of Trust dated February 22, 2016, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 963, at Page 375, given by Christopher Lee Holtzapfel and Michelle Parker, to Paul O. Clay, Jr., Trustee, for Charles E. Walker and Karen F. Walker, default having been made in the payment of the debt therein secured; and upon failure to cure said default; and being required by the beneficiary so to do, the undersigned Trustee will sell at public auction at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, on Thursday, October 26, 2017 at 10:30 a.m., the following described real estate situate in New Haven District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: TRACT NO. 1: Known and designated as Lot No. 3 (0.389) acres, as shown upon a map entitled "Westmoreland Coal Company, Winding Gulf Division, Landisburg Subdivision", being a part of the 17.545 acre Tract No. Two, Sewell Mountain District (now New Haven District), Fayette County, West Virginia, Scale 1" = 50', made by Charles A. Gregory, R. L. S., No. 426, April 20, 1973, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Map Book 18, at page 17, together with the right to use in common with the owners of the other lots shown thereon the roads, streets, alleys and ways and easements shown on said map, including but not limited to that certain "access easement" adjacent to the paralleling U.S. Route 19-W.VA. Route 41, being an easement over Lots Nos. 1, 2, 3 and part of Lot No. 4, thirty feet wide, and over the remainder of Lot No. 4 and Lot No. 5 twenty-five feet wide, as the same is shown on said map. TRACT NO. 2: Known as Lots No. 1 and 2, Landisburg Subdivision, as more particularly bounded and described on a map bearing the legend "Westmoreland Coal Company Winding Gulf Division Landisburg Subdivision being Part of 17.545 Ac. Tract No. 2 Sewell Mountain District, Fayette County, West Virginia Scale 1" = 50' Date 20 April, 1973", which map is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Map Book 18, at pages 17 and 18, reference to which said map is here made and made a part hereof for a more particular description of the two lots herein conveyed. And being that same tract or parcel of real estate conveyed unto Christopher Lee Holtzapfel and Michelle Parker by Charles E. Walker, by his attorney in fact, Karen Walker, pursuant to Power of Attorney dated April 17, 2007, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Power of Attorney Book 27, at page 485, and Karen F. Walker, dated February 22, 2016, which deed is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 731, at Page 679. The above described real estate will be conveyed by the undersigned Trustee to the purchasers thereof by deed containing a covenant of SPECIAL WARRANTY and subject to all liens, reservations and exceptions appearing in the record title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid Deed of Trust. The Trustee herein asserts, to the best of his knowledge and belief, that the parties in interest are not members of the Armed Forces of the United States, and are therefore not entitled to the benefits of the Service Members Civil Relief Act. REAL ESTATE TAXES: Subject property will be sold by the undersigned Trustee subject to real estate taxes presently a lien against subject real property. Any purchaser shall purchase subject to, and be responsible for, said real estate taxes. TERMS OF SALE: Cash on hand on day of sale. The above described real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owners of the indebtedness secured by the above described Deed of Trust and the owners of any other interest in the property to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE: The Trustee reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
